STEP 5: RENEWING YOUR VISA AND WORK PERMIT

Normally, work permit will expire the same date as the Extension of Stay does.

Foreigners need to extend their staying in Thailand before the Extension of Stay expires, and then need to renew their work permits thereafter. This can be done in Thailand or in some cases you must leave the country. If you cannot obtain your extension inside Thailand, you will have to get a new Non-Immigrant visa from a Thai Embassy or Consulate abroad. If you still have an unexpired multiple-entry visa, you can just go over the border and then return. If required to go outside Thailand to obtain a new visa, you will need to provide the Thai Embassy or Consulate with copies of your work permit and new recommendation letter from your company, company registration documents, and financial and tax reports. Our legal team can assist you for this matter. Again, all of this must be done prior to your work permit expiration.

Do not let Work Permit expire

If foreigners let their work permits expire before they submit their applications for renewal, the work permits are invalidated and they must have to start over again from the beginning to apply new work permit. Renewing a work permit is always a must, which is much easier and less costly than remedy of an expired work permit. However, if you really have to go abroad before the expiration date of work permit, you should submit a Renewal Application of work permit and pay a fee at the Department of Employment prior to that date. When you return from the country outside your work permit will be extended according to your new visa.

In several recent news articles and in speeches to various groups the Ministry of Labour has noted that although many aspects of work permits are vague and accommodations can be made that the Ministry of Labour is very strict concerning the expiration of work permits. If the permit expires, you need to start from the beginning and apply for a new work permit again.

Reporting your Stay every 90 days

Foreigners are required to report to Immigration Police every 90 days for people on a long term extension of stay. Peoples holding a multiple entry visa will simply depart Thailand and renew their extension of stay after each 90 day entry.
